Makhens Terms & Conditions

This page outlines the terms and conditions (referred to as “Terms”) that apply to the services provided by Makhens Limousine & Concierge ApS (referred to as “Makhens,” “we,” “us,” or “our”). Any changes to these Terms must be agreed upon in writing and approved by both Makhens and the customer (referred to as the “Customer”). An agreement between Makhens and the Customer is formalized in writing and referred to as the “Agreement.” Makhens’ contact information:

1. Prices & Payment

1.1. General prices 

The price for our services follows our applicable price at the time of order confirmation unless otherwise agreed in writing. 

1.2. VAT Applicability for Services and Vehicles

All prices are stated excluding VAT, as our services are exempt from the VAT rate on 25%. 

  • Concierge Services: Subject to standard VAT rate.
  • Limousine/transportation services: VAT-exempt, except for services delivered in Buses, Sprinters, and Coaches.
1.3. Surcharges

Night surcharges and fees for services outside Greater Copenhagen may apply. Certainly, we  disclose all additional charges prior to booking confirmation.

1.4. Payment

We offer secure and convenient payments through Stripe Payment Links. So, you will be sent a link, where you can use multiple payment methods, including credit/debit cards and digital wallets like Apple Pay and Google Pay The checkout process is quick, easy, and available in over 30 languages. As a result, your transaction is protected by Stripe’s advanced security measures, ensuring a safe and seamless payment experience.

The Customer shall pay the invoice via the provided payment link within the specified number of days from the invoice date unless otherwise agreed. Consequently, adherence to the payment timeline is essential to the terms and the validity of the Agreement.

1.4. Late & Unpaid Payment

Late Payment: If you fail to pay an invoice on time for reasons beyond our control, we will charge 5% interest per month on the overdue amount from the due date until you make the payment. Furthermore, if you don’t pay an overdue invoice within 10 days after we send a written notice or by the specific date we give you, we may:

    1. Terminate the sale of the services related to the delay.
    2. Terminate sales of undelivered services or demand prepayment for them.
    3. Exercise other legal remedies.

Unpaid invoice We reserve the right to cancel the Agreement and withhold the scheduled service if you haven’t paid the invoice prior to the service date. However, we will notify you at least 12 hours in advance that we will cancel the service unless we receive payment

2. Offers, Orders, And Order Confirmations

2.1. Offers & Confirmations

We revise our offer terms as follows:

  1. Our offers remain valid for 10 days from issuance, unless specified otherwise.
  2. We don’t consider acceptances received after this period binding without our written confirmation.
  3. We deem orders binding only after we provide written confirmation.
  4. We finalize your booking request only after we receive and confirm your payment.
2.2. Order changes

Neither the Customer nor Makhens may alter orders without prior written consent from the other party. Thus, both parties must communicate any changes within a reasonable timeframe to allow for accommodation.  Lastly, late changes made by the Customer may incur a handling fee, which we will inform you about. However, you retain the right to cancel the order and receive a full refund if done at least 24 hours before the scheduled pickup time. For complete details, please refer to our Cancellation Policy.

3. Delivery, Delays, And Defects

3.1. Delivery

Makhens will deliver the service(s) at the agreed time as outlined in the order confirmation. Thus, early or late deliveries cannot be expected unless agreed and confirmed by Makhens and the Customer. 

Danish Traffic Regulation Makhens strictly adheres to Danish traffic regulations while providing limousine services. This means that drivers are trained to comply with speed limits, traffic signs, and safety protocols, ensuring a safe and responsible travel experience for all passengers. 

3.2. Delays 

If a delay is expected, Makhens will inform and give the Customer a new expected delivery time at least one hour before the agreed service delivery time. Makhens is not liable for indirect losses such as loss of profit, time, or goodwill due to delays unless caused intentionally or through gross negligence. Furthermore, Makhens is not liable for delays caused by traffic or unforeseen circumstances beyond Makhens’ control. If Makhens fails to deliver the service(s) at no later than 15 minutes than the agreed time for reasons beyond the Customer’s control, the Customer is entitled to terminate the Agreement in writing without further notice and will be entitled to a full refund. 

3.3. Inspection

The Customer must inspect the delivered service(s) upon receipt. Any issues must be reported in writing immediately. Otherwise, if not reported within reasonable time, the issue(s) cannot be claimed later (after the service has been completed). 

4. Cancellation Policy

4.1. General Policy 

The cancellation policy for the Customer is outlined as follows:

  • Cancellations made by the Customer more than 24 hours prior to the scheduled pickup time: Eligible for a full refund.
  • Cancellations made by the Customer less than 24 hours prior to the scheduled pickup time: No refund will be issued.
  • In the event of a no-show*: No refund will be issued.

*No-show refers to the Customer not showing up to the Agreement (the agreed time and place to be picked-up).

4.2. Chauffeur Rights 

Drugs & Alcohol Makhens reserves the right to refuse transportation and has the right to terminate the Agreement without the Customer being entitled to a refund, in cases involving inappropriate behavior or intoxication, including but not limited to alcohol and or drug use. 

 

5. Personal Data

5.1. Customer Data 

The Customer must provide personal data, such as full name, phone number, and email address, for Makhens to confirm the booking and for service delivery. You can read about our Privacy Policy which describes how we process personal data. 

6. Damage & Cleanliness

6.1. Damage 

If the Customer damages the vehicle and it requires specialized cleaning or repairs, the Customer must take full responsibility for covering all cleaning and repair costs. Moreover, if the damage prevents the vehicle from being used, Makhens will hold the Customer accountable for any financial losses, including canceled bookings or missed appointments.

Before each service, we take photographs of the vehicle to document its condition both before and after the service, ensuring accurate records of any damage caused by the Customer.

Additionally, Makhens enforces a strict no-smoking policy. If a Customer smokes in the vehicle, we will charge a fine of 10,000 DKK to cover the cleaning costs and compensate for taking the car out of service for one day to remove all odors.

6.2. Cleanliness

We thoroughly wash and clean the selected vehicle before delivering any service, ensuring the highest standards of cleanliness, presentation and experience.

7. Complaint & Jurisdiction

7.1. Complain 

If you have a complaint about our services, you can submit it to the Danish Consumer Complaints Board at Carl Jacobsens Vej 35, 2500 Valby. File your complaint via www.forbrug.dk. EU consumers outside Denmark can use the European Commission’s Online Dispute Resolution (ODR) platform at http://ec.europa.eu/odr. Include our email address: info@makhens.com when submitting your complaint

Please note that from May 13, 2024, the ODR platform will no longer accept requests for direct talks, but you can still submit complaints
 
7.2. Jurisdiction 

We govern this Agreement under Danish law, and we will exclusively settle any disputes in Danish courts.
